An Analysis of Law on Marital Rape

Rape is derived from a word “Raptio” which means “to seize” As far as  the meaning of Marital Rape is concerned, it is relevant to note that the Penal Laws of our Country i.e. Indian Penal Code and Cr.PC has not yet it defined and not made an offence,  in case, where wife is above 18 years of age, but by way of judicial interpretation we may define it as “Marital Rape  is committed when sexual intercourse act committed by husband with his wife without her consent or by force or even against her wish.  At this juncture, it is relevant to note that Indian Penal Code do recognise that Judicial Separated husband can commit the offence of Rape with his wife, if she is not the willing/consent Party to do sexual act. The said issue of Marital Rape has been come into highlight in the wake of recently pronounced two judgments of the High Court in India viz Chhatisgarh and Kerala High Courts. The Chhattisgarh High Court in the revision petition filed before it in the case of Dilip Pandey &

Opportunities during Lockdown

In the recent days we have learnt a lot of new words- Lockdown, Quarantine, Social distance etc. We all lived in the past two years two times in Lockdown and in some countries more than two times. Covid-19 has also raised the opportunities of touch less technology. Daily in the morning we move to our offices and used different method of attendance. The methods could be attendance, thumb impression, RFID card, Bar code etc.Covid-19 has raised the opportunities to work on touch less technologies. In the past year we have seen touch less temperature scanning machine, before Covid-19 we were not using this machine in general. Now a day’s almost every organization has at least this touch less technology. Similarly in near future we will see that our attendance will be taken through touch less technology whether it is taken by finger scanning without touching the machine, face scanning machine, iris technology, wave movement or any other method. New Tax Policy Or Old Tax Policy Which Is Better

Let begin with understanding new tax rules. It has six tax slabs, each having a lower rate on income up to Rs. 15 lakhs. Multiple exemptions and deductions are not available due to the varied income slabs and tax rates. There are benefits and drawbacks to the new tax system.  The present tax regime is still in effect, and we, as a taxpayer, have the option of choosing between the old and new tax regimes that best fit your needs. The government has not imposed any penalties for failing to transition to the new tax system. Taxpayers can invest their money in whatever manner they wish under the new tax structure. There is no need to invest in tax-saving schemes or insurance policies that may or may not be in accordance with their financial goals under the new program. With various tax brackets to choose from, you, the taxpayer, will be placed in the one that best reflects your yearly income. Dr. Shalini Singh Assistant Professor Department of Commerce

ESSENTIAL RELIGIOUS PRACTICES DOCTRINE AND ITS EFFECT ON SECULARISM

India being a land of diverse religions and cultures, there are various religions namely Hinduism, Islam, Christianity, Jainism, Sikhism and Buddhism. Therefore, to avoid any conflict in such multireligious nation, the concept of secularism was adopted. Secularism in simple words means state recognizes no religion but respect all religions. The word 'secular' was added in the Preamble in the year 1976 in Indian Constitution. Although the concept of secularism is adopted from western countries but India follows such secularism model with slight deviation such as state interference is allowed in case of secular practices associated with religion under Article 25 of Indian Constitution. Thus, Indian Judiciary has played important role in reshaping the elements of secularism through Essential Religious Practices Doctrine (ERP) as evolved in case of Commissioner, Hindu Religious Endowments, Madras v. Sri Lakshimindra Thirtha Swamiar of Sri Shirur Mutt . This article throws a light

WHY NOVELS ARE BETTER THAN MOVIES

Shilpa Sharma ECE Department   We all know how great art is whether it be music, movies, novels, etc. but most art does not have the same effect, a piece of music can be more powerful than a whole movie. What I really want to talk about is how novels have a better effect than movie can have, before diving into the topic I want to clarify that art is subjective, everyone has different taste, so this is just a mere opinion. Okay, so why novels are better than movies you might ask. Well when you think about the essence of movies then it is just a combination of different artists, from visionary and great directors to actors, screenwriters and many more. A film is a compilation of art which can be revolutionary if handed to the right artists and I myself admire movies but the problem is that movies are made on the basis of the director’s vision of the story, for example if there is a scene in which a character died which is directed by the director(obviously) it would have sad music, cha

BITCOINS AND THE RISK INVOLVED

What is bitcoin? Bitcoin is basically an open source, peer to peer digital currency. Amidst many other things, what makes bitcoin exceptional and distinctive is the fact that it is the world’s first completely decentralised digital payments system that is to say that it is under no centralized authority. Santoshi Nakamoto in the original whitepaper that he published on bitcoin in 2009 had said that trade and commerce on internet is solely dependent upon financial institutions filling in as trusted third parties in order to process electronic payment . For instance, if X wants to send 1000 INR to Y over internet, he would have had to depend upon a trusted third party like Paypal or Google Wallet. These parties keep a record or ledger of their account holder’s balances and when this third party would send money to Y they would deduct 1000 INR from X’s account balance and would add it to Y’s account. Although this system functions well enough but it has certain limitations like marginal

GOVERNMENT EFFORTS TOWARDS RECYCLING PLASTIC

For the very first time, the medals given in the Tokyo Olympics 2020 were made of recycled materials . The decision to reuse things mirrors a checked change in how individuals are turning out to be all the more earth cognizant now about the items they devour. For quite a while, crude materials are utilized to make an item and the item is disposed of after it has been utilized. The ozone depletion is causing environmental change. Our economy depends on reusing where materials are reused to their most extreme potential. For instance, broken glass bottles are utilized to make new jugs or fiberglass while the scratch pad can be reused into paper towels, facial tissues or new note pad. As of recently, endeavours to handle the environment emergency have zeroed in on changing to environmentally friendly power, supplemented by energy productivity. Assuming we need to cover the whole curve of outflows, we need to change the manner in which we make and use items. India also has started taking

Citizen Rights and Cyber Security

An act was declared as the fundamental right by the honourable Supreme Court of India in 2017 which can be derived from the constitution of India under articles 14, 19 and 21. It was a historic judgement followed by a long term media coverage. The Advocate General of India argued about the absence of any such fundamental right which can protect the privacy of an Indian citizen. During this argument, the right to privacy act emerged, established and become part of the Indian constitution.  A new question arises about personal data protection whether the data belong to an organisation or an individual. The fundamental role of an organisation and a citizen is to follow and act according to the constitution of the nation. Although it seems that the regular attacks on citizens personal data make it difficult for anyone to tackle the situation. A recent incident occurred where a 28 years old man holding about a thousand fake aadhaar cards. We come across similar stories in a daily which al

Taliban isn't near anybody; swords can be drawn with Pakistan over Durand Line

Taliban representative Zabiullah Mujahid as of late told a Pashto divert in Pakistan that Afghanistan goes against the fence worked by Pakistan on the Durand Line. "The modern Afghan government will report its circumstance on the issue. The limit has isolated individuals and isolated families. We need to establish a protected and serene climate along the line, so there is no compelling reason to make obstructions."  The issue has planted question among Afghans and Pakistan for quite a long time and raised the possibility of a potential fighting in relations between the Taliban and Pakistan.  The Durand Line is a legacy of the tremendous nineteenth century game between the Russian and British Empires, in which Afghanistan was used by the British as a help against a feared Russian expansionism in the east. On November 12, 1893, an arrangement known as the Durand Line was endorsed between British government worker Sir Henry Mortimer Durand and the then Afghan ruler Amir Abdur

First law of motion ( Inertia)

When any object move, then how many types of laws will exist comes in the category of laws of motion. Inertia- Inherent property of body means- not change by self So if the body at rest, then it cannot change its position by itself. When an external force is applied then the object will change its position and when object is in motion, again we have to apply a force to stop it. Inertia in linear motion depends on the mass of the object. Inertia is proportional to the mass of the object. There are three types of Inertia- 1) Inertia of rest- means when the body is at rest will remain at rest, it will not change its position without any external force applied to it. 2) Inertia of motion- means when the body is in motion, will remain in motion, it is not able to change its condition of motion. 3) Inertia of direction- means when a body is moving in some particular direction cannot change its direction and keep on moving in the same direction. So an agent which is known as force to change

Self-Realization

The quality of your life depends on how well you manage your body, mind, emotions and your situations. Your life in general and the world means how much value you give to yourself. In this modern world we are forgetting ourselves, we are losing our identity perhaps we forgot from where we started this journey. In this catastrophe of development, we made different things for our benefits, for our luxury but at the end we will get nothing rather we will spoil it. We made cars but we forgot to walk, we made phones but we forgot to meet with people, we made different machines and technologies but we forgot to talk to ourselves. We don't have time for ourselves. Until we spread our wings we will have no idea how far we can fly. When we experience the storms of life, we need to spread our wings. Sometimes we are tested in life and could sink in the mire of our problems. We may see our problems as a burden. Instead we could see them as opportunities for inner growth. This inner growth c

BUSINESS ETHICS VS. SOCIAL RESPONSIBILITY

Dr. Shikha Jalota Associate Professor JIMS Engineering Management Technical Campus Greater Noida Social responsibility and ethical manners in business would bring various benefits to the improvements for the society as well in business developments. Both are interrelated with each other. In other words, social responsibility is associated with business policy. In simple terms, the business has to be carried out, keeping in mind that it should bring a healthy and conducive environment in the society.
