Filling the Gap: Investigation-Conviction An analysis of Criminal Investigation system in India

Criminal Judicial system of any country more or less is dependent on the investigation report which have direct link with crime conviction ratio . There may be various reasons for poor conviction ratio like shortage of police force, delayed reporting of the cases, long judicial trial, unavailability of evidence etc. The last one is directly related with the investigation. However, there may be various reasons for non availability of evidence, because evidence includes both oral and documentary evidence. In regard to oral evidence there are two types of evidence first the statement of accused himself and second one is the statements of witnesses.   Right to remain silent is major hurdle in respect to statement of accused and on other side lackness of administrative or judicial support in regard to other witnesses. So basically the police have to depend on other sources of evidence which are generally collected from crime scene. Selection and collection of evidence are two differe...

AI strategies are utilized to consequently locate the significant hidden examples inside complex information that we would somehow or another battle to find. The concealed examples and information about an issue can be utilized to anticipate future occasions and play out a wide range of complex basic leadership. Generally, progr...

ENTREPRENEURSHIP IN INDIA

Entrepreneurship has been a buzzword in Indian business ecosystem for about half-a-decade. As enhancements in technology keeps on expanding the business horizons and opportunities, many more students have considered walking along the path of entrepreneurship instead of resorting to secured employment. They fantasize establishing their own global empires on what currently exists as a barren plot of land. However, most of these ventures, fuelled by youthful and passionate minds, cease to exist for one or a multitude of factors in within first three years of operations. The foremost reason behind the collapse of current-age start-ups in India is the lack of business acumen within the whole team. Several components have to be nurtured before knocking the doors of entrepreneurship. These include – Business Strategizing, Bootstrapping, Business Development and Growth-related Operations, Financial Analysis and Projections, Consultancy, Diplomacy, and so on. In the Indian start-up play...

RIGHT TO HEALTH AND ITS DEPRIVATION VIS-À-VIS CHILDREN OF INCARCERATED PARENTS

India has ratified the Convention on Rights of Child . The idealistic instrument provides for attainment of highest desirable standards of health for children. Even though the spirit of the Convention has been imbibed in the country’s municipal laws such as Juvenile Justice Act, POCSO amongst others, a category of children seem to be negligently or deliberately, nonetheless wrongfully excluded from the protection guaranteed by such social justice laws. This category of children, are not only socially stigmatized and ostracized, but are nowhere in the priority list of policymakers. Even though the present day legislations and judicial pronouncements have started acknowledging children’s rights in general, no concrete steps have been taken for the upliftment of children of incarcerated parents. The lack of regulatory framework and fragmented policies, with some States coming forward with rudimentary institutional support to these children and others blatantly ignoring their plight, ha...

Be the Change

India known as land of diverse cultures, languages, ideology, rituals and so many different attributes, is facing problems due to diversity of human perceptions. It is the country where we celebrate the diversity, we respect the differences and we live with them. Respecting other’s differences is what we have in our culture and yes, we are known for this in the whole world. We are known for assimilating everyone irrespective of every minutest and every major difference. But today we are also getting recognized with the diversity of ideology that all of us have for crimes and unacceptable activities. Some of us are trying to politicize the crime, some are trying to mould it in terms of religion, in the name of community and so many factors which take us miles away from the actual state of crime. Everyone on this planet perceives the situation in his own way, which is completely acceptable because we all are different, we all have different thinking style and ofcourse different mi...

ARTICLE 370 A TEMPORARY PROVISIONS THAT SOUGHT PERMANENCY

Jammu &Kashmir is a land of promise, a promise to religion, culture, nation and most importantly politics. Kashmir has gone through various invasions but has always stood its ground. Many times those who came as friends have turned its foe yet the issue for everyone who is not involved in this issue has always been that why even after so many invasions, Kashmir is hostile to invaders. The demands of the people of Kashmir can never be met as those who rule it have always had a different plan for it. The people of J&K now no longer have any belief on their rulers and rightly so, as everyone has their own plan for them as per their personal agenda. The general population of J&K believes that they have never received what they want and therefore they don’t have any recourse to justice as they have never received it. The general public of India on the other hand believes that J&K should feel grateful to India for supporting it so long. But they fail to comprehend that J...

Effectiveness of the Test Item

Sometime, as part of the accreditation processes it may be required to know the level of the test items. Is there any way of finding whether the test item asked in an examination is good enough to distinguish between a good and a weak student. Or it may be required to know whether the question is easy enough so that every student weak or good is able to answer it, or no one or most of the student are not able to answer. The analysis of the result may reveal some information that is being discussed in this blog. I present these two terms as the facilitation value and the discrimination value which are elaborated in the following section. In this process about 60% of the student are tested for their performance in an examination. This sample is quite large to deduce about the level of the question. The steps involved are: a.        Tabulate the marks of the test item and the score for all question by all students. b.       ...

Groundwater Depletion

Groundwater consumption is a genuine danger to the earth. Most of our bodies and the Earth is comprised of water. We may see the excellent, streaming surface waters that make up the seas, lakes and waterways, yet this water isn't constantly ok for utilization and is significantly harder to channel than groundwater. Therefore, water starting from the earliest stage particularly profitable. Groundwater is something that we need everywhere throughout the world. People and creatures need water so as to get by as our bodies couldn't work without it. We likewise need water to help us in developing harvests, fueling hardware, and to keep us agreeable. Social orders require considerably more spotless water than we are managed from precipitation and surface water, which is the reason groundwater is utilized so often. If you somehow managed to see groundwater moving, you'll likely think that its fascinating that so much water lies underneath us. From a 10,000 foot see, you ma...

On 5 th August 2019, a historical step was initiate by Honorable Union Home Minister of India Mr. Amit Shah that scrapped Article370 of the Indian Constitution which gives special status to the State of J&K. It was the most awaited stride, as due to this special Status the Central government was allowed to interfere in the internal as well as external affairs of the state of J& K. After the removal of the Special Status now the State of J&K will be marked as Union Territory and Ladakh as second Union Territory (after the bill to be approved in both Houses - Lok Sabha and Rajya Sabha). Now there will be no separate flag for the State of J & K, tricolor will be flagged in the state. Now, every citizen of India has a right to know about the whereabouts of the Government of...

India’s Paradox of Plenty

Paradox of plenty or the resource curse (Richard Auty used this term for the first time I 1993) refers to a paradox that countries having abundant natural resources tend to grow slower than other countries having relatively fewer resources. This paradox generally refers to natural resources like oil etc., but in India we can attribute the same to Demographic mileage also. Countries like Japan, Canada etc. despite have successfully brought themselves up even without having demographic dividend. Despite having the largest chunk of young population, around 35% in the age group of 22-38, we are unable to take advantage of this demographic dividend. Last year, Aspiring minds did a study on the employability on the young engineers and concluded that around 94% of the engineers are not employable, or we can rather say they are not industry ready. NASSCOM-McKinsey report said that not more than 26% of Indian engineering graduates are employable. This is not about engineering only, the sa...

SELF – DEFENCE

Conferring to the authorised vocabulary , the term for self – security is “the practice of equitable strength to defend oneself or members of the family from physical injury from the attack of an antagonist, if the protector has purpose to believe he/she/they is/are in threat”. Now if somebody is questioned what self-defence means, of course any mature person would know accurately what the word meant. However if a kid were to be asked what self-defence means, many would be confused on what accurately self-defence is or what is it even used for. As criminality has been increasing nowadays, this raises apprehension if a person were ever find himself or herself in a life threatening state, he/she would do?? Mainly, self-defence training forms our assurance on ourselves. We become self-reliant, cerebral responsive  and ready to hostage an unpredicted poultry  anytime. The exercises can specifically help us while facing the snatchers or muggers. Nowadays, people become tar...

Memory – Nature’s Gift to mankind

Humans are blessed with the capacity to retain the learnt material and experiences for a long period of time and then reproduce it through recognition and recall when required, this capacity is termed as memory. Memory varies from short term memory which is mostly used in daily life, where the content is immediately recalled after the experience and soon forgotten. Long term memory refers to the memory as a store house where information is stored permanently. If short term memory is used regularly it gets converted to long term memory. Students are immensely benefited by this type of memory. Part, whole and rote memory - as the name suggests the content is remembered in parts whereas whole memory is photographic memory where nothing is forgotten. In rote memory the textual matter is reproduced may be without any understanding and at times without any error. Insightful memory is extremely useful for students, as the content is presented through conceptual understanding.. T...

Everyone aspires to be greater than what they are. Whatever they might think is greater, they try to do that. It is the basic human aspiration . Whether you try to be a great student, a great teacher, a great musician, a great businessman, a great professional, a great politician, a great artist or a great addict; you are essentially trying to be better at something that you think makes you greater. But have we ever tried to be a Great Human? Now don't already start judging yourself. There were sometimes that you did something that a great human being would have done. Humans among us have been doing so many great things. Still we think we can't do that – they were better. The reason for these thoughts – Fear. We are scared. Now if a genie blesses you that you can do and be whatever that you want to be, then would you want to be a great Human being? I would request you to write three things that you think make a human being wonderful. Not great, but wonderful. I used the ...
