SCRAPPING OF ARTICLE 370 OF THE CONSTITUTION OF INDIA- ITS PROS AND CONS


On 5th August 2019, a historical step was initiate by Honorable Union Home Minister of India Mr. Amit Shah that scrapped Article370 of the Indian Constitution which gives special status to the State of J&K. It was the most awaited stride, as due to this special Status the Central government was allowed to interfere in the internal as well as external affairs of the state of J& K.
After the removal of the Special Status now the State of J&K will be marked as Union Territory and Ladakh as second Union Territory (after the bill to be approved in both Houses - Lok Sabha and Rajya Sabha). This is a very major step by the Central Government when it comes to managing 'things' in the ‘Heaven on the Earth’ or valley it will have grave impact on the future generations as well. Now there will be no separate flag for the State of J & K, tricolor will be flagged in the state.
Now, every citizen of India has a right to know about the whereabouts of the Government of the State as they will have Right to information. Article 360 of the Indian Constitution will now be applicable. This move also nullifies the Article 35A of the Indian Constitution. Due to this initiative now the industrialist will take more interest to establish different types of industries and it can create environmental related problem to the people of Kashmir as it will produced lots of waste. As commercialization and industrialization can increase the employment in State of J & K but it will fade the beauty of the valley as it may result in so much noise pollution, water pollution and other related issues. So, stringent rules and policies should be framed for the industries those are showing interest for the same. Now, no dual citizenship will be applicable for the Kashmiri citizens, which are not going down very well with many locals.
