Fundamental Right of Protection of Life of Corona Warriors in the midst of the Covid-19.
In view of the fact that first corona virus patient was found in
India in the end of January 2020, from then many corona warriors especially the
heath care workers and police personnel have been subjected to abuse and
violence while performing the duties. Most of the attack on the corona warriors
especially healthcare workers and police officials are found in the areas wherein
these personnel had gone for collecting the sample from the suspected patients suffering
from the said corona virus. At the outset, the said attack on the corona
warriors is condemn able as they have gone for protecting the patients living in
the said area without thinking about their own lives. As these warriors are
more prone to the attack as this virus spreads in person through contact. The Constitution
of India also protects corona warriors’ right to life under Article 21 of the
Constitution of India and it is duty of the state to protect them. But certain
media reports show that the attack on these warriors by a certain class of
citizens but till late the effective machinery could not place by the
respective Government i.e. both at the Central and State Government even though
there is a constitutional provision and the law on the point. The first step taken
by the Government to stop these attacks on the corona warriors by the said section of class of
citizens is to be taken as symbolic gestures such as clapping hands and
lighting candles in recognition of their selfless service, but the same doesn’t
create awareness amongst a section of a class of citizens. To stop violence against the corona warriors,
Parliament has to come up with an ordinance, though late, thereby to amend the
Epidemics Diseases Act 1957 which makes acts of violence against corono
warriors personnel a cognizable and non bailable offence and also provides a compensation in case of
injury or loss to the property. But despite the said amendment in the law, the
violence against the corona warriors is still going on and yet not stopped. Therefore,
negative messaging which causes fear of stigma on being corono virus patients to
be stopped and action must be taken against the violators. Further, State must
effectively implement law against the persons involved in the violence. In the
end, Corona warriors who are forced to work in long shifts treating and
managing covid patients needs absolute
support and cooperation from the public without which the same cannot be
stopped.
