Manual Scavengers: A Stinky Legacy of Suffocation for the State to Solve

 

From Nomadic to Cosmopolitan society, it can see the progressive society has taken place in various spheres. Various stages of development took place from time to time. India is secular country and does not follow any religion. But humans are considered beyond humanity in today’s era too. India is considered one of the divisions of caste and communities. During the times of Vedas too division of caste was in accordance with Brahmins, Kshatriyas, Vaishyas and Shudra. And person was classified as accordance to their status. Later on caste become a fundamental aspect and society stratified according to the changes brought by humans. Old aged traditions revealed various sociological changes which were brought in the society and later on it became the concept of modernity. Looking into the caste culture which is followed in various places, caste became one of the barriers. Later on development too place and Manual Scavenging is considered as one of the most practices of untouchability which has not been eradicated in India till now. Dalits are another society which carries on same profession as their main source of earning. And these communities are often faces various problems like discrimination, pain, occupational hazards, untouchables etc. Caste based works is often witness in past from Henry Maine Status to contract theory to Khuman Singh v. State of Madhya Pradesh, even after the implementation of Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act, known as the Schedule Caste/Schedule Tribe Act, 1989. Today discrimination on basis of the caste is an offence but at large the practice of such is still prevalent in various parts of India without any hesitation. The economic status Manual scavengers are very substandard. The Employment of Manual Scavengers and Construction of Dry Latrines (Prohibition) Act, 1993 came into force, which dealt with protection of human safety and other issues. Later on Prohibition of Employment as Manual Scavengers and their Rehabilitation Act, (2013) not only defined rehabilitation with respect to human dignity but also deals with injustice suffered by manual scavengers. Plethora of legislations has been implemented to deal with these issues, in order to make a casteless society. But manual scavengers as considered as specific class of society and they carry the same badge with years and years. This filthy profession still exists even after the advancement of technology scientifically which can save the manual labour work. It is considered as one of the inhuman works which violates the human right of individual’s while carrying human excreta with the help of broom or metal scrappers and even with bare hands too. The practice is still prevalent in urban as well as rural areas even after enforcement of laws and various schemes organized and executed by the government.
