In today's era of information technology the focus of country is on digital India. Use of science and technology by criminals, in commission of crime, is increasing day by day and to deal with such crime and criminals, it is very important that the investigating agencies must be aware and trained about such technologies. Collection of scientific evidence is important aspect of crime investigation, police officers involved in collection of direct evidence, are hardly trained in collection of scientific evidence. Another issue is that there is neither specific guideline of court nor any specific law to deal with scientific investigation. By the Information Technology Act, 2000 certain amendments were done in Indian Evidence Act, 1872 in regard to admissibility of scientific evidence; however that is subject to some condition laid down in the Act. During investigation investigating agencies collect a number of scientific evidence like tape recorded conversation, mobile communication...

“The aforesaid topic became important in the light of recent judgment of SC wherein an issue has been dealt by the Apex Court, whether a non-Compoundable Offence under section 306 Indian Penal Code (IPC), 1860 can be quashed in a proceeding under Section 482 Code of Criminal Procedure (Cr.PC) 1973. At this juncture, one must know the Definition of Non-Compoundable Offence, it is to be noted that the said expression is not defined anywhere in Code of Cr.Pc1973, but the same can be inferred as  an offence which cannot be compromised between the parties to a criminal case. Social Implications of The MTP, 1971 Act:

Govt. of India has enacted much social legislation since independence. In practice  we discover  that these very good social legislation have remained in the books and the govt.  isn't  able to implement these laws. The anti dowry bill or the Child marriage bill or the anti sati bill are few instances. Child marriages still takes place. The MTPA  is that the  only social legislation that has found wide acceptance without any resentment. Unwanted pregnancy  may be a  social stress in all societies. Before the MTP act, unwanted pregnancy was managed by resorting to illegal abortion, infanticide or deserting the new born in lonely places. Now with the MTP act, the social fears are considerably reduced  and therefore the  urban and the rural community have taken advantage of the Act. Patterns of sexual and reproductive behaviour have changed significantly over the years.  Most vital  change is the increase in the premarital se...

Basic concept of Cyber Terrorism and Cyber crimes

Most people would say they know what terrorism is, but surprisingly there is no internationally agreed definition. There is literally hundreds of different definitions incurrent use with the use of violence or threat of violence being the only general common theme. The only other elements to appear in more than 50% of definitions are “Political” and “fear, terror emphasized”. This is a hamper on international cooperation as some terrorist organizations are seen as legitimate fighters by some countries. Terrorism does differ from other crimes in its mens rea ; it is done with a purpose and a specific strategic outcome in mind. If there has been significant international and intellectual disagreement about a definition for terrorism itself, the disagreement as to what, if anything, constitutes Cyber Terrorism is even more diverse. This paper will consider the battle against terrorism in Cyberspace, Cyber Terrorism as a form of attack and the terrorist use of the Internet as a tool ...
